Welcome to Oh My Days
This website is operated by Oh My Days (“we”, “us”, “our”). Throughout the site, the terms “we”, “us” and “our” refer to Oh My Days. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including those additional terms and conditions and policies referenced here and/or available by hyperlink. If you do not agree, please don’t use our website or services.
Our online store is hosted on Shopify Inc., which provides us with the e-commerce platform to sell our products and services to you.
1. Online Store Terms
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you have given us consent to allow any of your minor dependents to use this site.
You agree not to use our products for any illegal or unauthorised purpose, or in violation of any applicable laws (including but not limited to copyright laws). You must not transmit any worms, viruses, or destructive code. A breach of these Terms may result in immediate termination of your Services.
2. General Conditions
We reserve the right to refuse service to anyone for any reason at any time. Your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.
3. Products and Availability
All products are made fresh and subject to availability. We strive to keep our listings accurate, but from time to time, items may sell out or become unavailable. If we can’t fulfil your order, we’ll let you know and offer a refund or alternative.
We’ve done our best to display product colours and images accurately. We can’t guarantee that your screen displays them perfectly.
We reserve the right to limit the sales of our products or Services to any person, geographic region, or jurisdiction and may exercise this right on a case-by-case basis. We reserve the right to discontinue products at any time.
4. Pricing and Payment
All prices are listed in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice.
We accept major credit cards, debit cards, and other payment methods available at checkout. Payment must be received in full before we process your order. We reserve the right to refuse any order you place with us.
You agree to provide current, complete, and accurate purchase and account information for all orders. Please keep your account up to date so we can complete transactions and contact you as needed.
5. Delivery and Pickup
We offer delivery within Sydney metro areas and pickup at our Glebe and Petersham locations. Delivery fees and estimated times are displayed at checkout. We aim to deliver on time but can’t guarantee exact windows. Pickup orders are available during store hours.
6. Refunds and Returns
Due to the perishable nature of our products, we don’t accept returns or exchanges. If there’s an issue with your order, please contact us at hello@ohmydays.com.au within 24 hours of delivery, and we’ll do our best to resolve it.
7. Accuracy of Information
We’re not responsible if information on this site isn’t accurate, complete, or current. Content is for general information only and shouldn’t be relied on as the sole basis for decisions. Historical information may not be current and is provided for reference only. We reserve the right to modify site content at any time, but have no obligation to update it.
8. Optional Tools and Third-Party Links
We may provide access to third-party tools or links to third-party websites. We’re not responsible for monitoring, evaluating, or endorsing third-party tools or content. Use them at your own risk. Please review their terms before engaging in any transaction.
9. User Comments and Feedback
If you submit comments, suggestions, or other materials to us (collectively, “Comments”), you agree that we may use, edit, copy, publish, and distribute them without restriction. We’re not obligated to maintain Comments in confidence, pay compensation, or respond.
You agree your Comments won’t violate any third-party rights, contain unlawful or abusive material, or include any malware. We may remove content at our discretion if it violates these Terms or applicable law.

Your submission of personal information through the store is governed by our Privacy Policy. Please review it for details on how we handle your data.
11. Errors, Inaccuracies, and Omissions
Occasionally, our site may contain typographical errors, inaccuracies, or omissions (e.g. product descriptions, pricing, promotions). We reserve the right to correct these errors at any time without notice, including after you’ve submitted your order.

You agree to indemnify and hold harmless Oh My Days, our directors, officers, employees, agents, contractors, and suppliers from any claim or demand, including legal fees, made by any third party arising out of your breach of these Terms or your violation of any law or third-party rights.

These Terms are effective unless terminated by either you or us. You may terminate by notifying us that you no longer wish to use our Services. We may terminate or suspend access to the Service at any time for violation of these Terms or applicable laws.

These Terms, along with any policies or operating rules posted by us on this site, constitute the entire agreement and understanding between you and us and govern your use of the Service. Any ambiguities will not be construed against the drafting party.

22. Mobile Terms of Service
Oh My Days Bakery

The Oh My Days Bakery mobile message service (the "Service") is operated by Oh My Days Bakery (“Oh My Days Bakery”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to Oh My Days Bakery’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Oh My Days Bakery through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Oh My Days Bakery. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Service at any time. Text the single keyword command STOP to Oh My Days or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Oh My Days Bakery mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
